These terms and conditions apply to the use of this website and the ordering, purchase, fulfilment and delivery of Products from www.labmallx.com. Please read the Terms and Conditions carefully before placing your Order. These Terms and Conditions contain important information about the ordering, processing, fulfilment and delivery of goods, including limitations of liability. Labmallx reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes

1. Warranty

Each Product sold on the Website is covered by a 12 months standard warranty from date of invoice from Labmallx (PLT Scientific Sdn Bhd), Malaysia. Warranty is only applicable for manufacturing defects and not for consumable items.

The Company carries products from a variety of distinguished manufacturers. The manufacturers of products carried by us have been chosen on the basis of the Company’s belief that their products meet the Company’s rigorous specifications and standards. Statements made in our catalog and on this Site regarding these product specifications, standards, manufacturer warranties and suitability for a particular use are made to the best knowledge of the manufacturers, and the terms of such warranties will be made available to the purchaser without recourse against the Company.  You understand and agree that the Company has not verified, nor does it have an obligation to verify, any information provided by the manufacturers, nor confirmed whether the products meet the specifications of the products they apply to.

2. Cancellation

We understand that sometimes mistakes are made and orders need to be cancelled or postponed. When that is the case, please contact us immediately by phone to discuss cancelling an order. If the order has not shipped, we will make a reasonable effort to cancel the order without further penalty. For orders that have shipped, please follow the returns policy noted above. Restrictions may apply for cancellation on certain products that are noted as non-returnable or non-cancellable on order acknowledgements

2.1 Cancellation Criteria

a)Incorrect or Incomplete information regarding Customer’s address (Street number, Landmark etc.) etc.
b)In case of wrong product price or specification mentioned on labmallx.com.
c)Unavailability of products – in exceptional cases, if a product runs “out of stock” with the vendor, the product will be cancelled.
d)If area falls under “Non Serviceable zone” or “out of delivery area” by our Logistic Courier Partner even after placing the order in that case order can be cancelled.
e)Suspected fraudulent information.

3. Return

All returns must have prior authorization from Labmallx and must be requested within 30 days of delivery. Products returned without prior authorization will be returned freight collect. All products returned are subject to a minimum 20% restocking fee plus any applicable charges for necessary inspection, reworking or refurbishing. Customer will be responsible for all transportation fees on returns not due to Labmallx error.

 3.1 Guidelines for Returns & Replacement

a) Product is damaged/defective.
b) Products should be unused.
b) Differ from the description on the website.
c) Wrong item delivered/Wrong Colour/Wrong Size/Wrong Quantity.
d) Missing parts/accessories.
e) All items must be returned in their original condition, with price tags intact, user manual, warranty cards, invoice, original accessories and in the original manufacturer’s box/packaging as delivered to you

3.2 Products generally not subject to return include:

a) Items not purchased from Labmallx.
b) Products not in original packaging, including products with damaged, missing, or defaced labeling and packaging.
c) All original manuals, instructions, warnings, and warranties must be included.
d) Products must not have been customized, modified or damaged in any way.
e) Items purchased on a “special order” basis or discontinued products.
f) Chemicals, diagnostics, sterile or controlled products.
g) Products with an expired shelf life or short expiration dating less than six (6) months.
h) Products which are not inventoried by Labmallx and are not able to be returned to the manufacturer.
i) Refrigerated products or other perishables.
j) Products that may be identified as high demand due to a pandemic, epidemic or other situations of crisis**
** Please note that in times of crisis or emergencies, demand can significantly exceed supply. This can result in allocations of products by our suppliers and for our customers. As a result, our terms may be amended, such as requiring payment in advance, freight charges and products that are considered Final Sale and/or Non-Returnable and/or Non-Cancellable.

3.3 Returning a Product

There are 2 ways to Return the product. One is to return the product from our side where we send the courier partner and get the product picked up from customers. However, in some cases if we cannot provide return service then customer needs to send the product to us.

4. Refund

Refunds will only be granted for Item(s) that were in-stock at the time of purchase. Seller reserves the right not to issue a refund if replacement products are available within 3 weeks from the date of receipt of return items.
Buyers who purchase with direct payment, e.g. by credit card, FPX, eWallet, will receive a refund which can be used to offset future purchases. Refund vouchers cannot be exchanged for cash and are subject to 90 days validity upon issuance.Buyers with established credit terms with Seller will receive a credit note and Buyer’s credit balance will be reversed. All refunds may take up to 10 business days to be processed.

5. Liability

To the extent permitted by law we will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise; and our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

6.Miscellaneous

Title and risk in the Labmallx Products pass to You at the point of dispatch or embarkation by Labmallx to Your courier.

Labmallx Malaysia reserves the right to make changes to the Labmallx Malaysia Website and these Terms and Conditions without notice. For the avoidance of doubt, any such changes will operate prospectively from the time that the revised Terms and Conditions are published on the website and will not impact any Purchase Contracts entered into prior to the date of the publication of the revised Terms and Conditions.

Any provision of these Terms and Conditions which is void or unenforceable may be severed from these Terms and Conditions without affecting the enforceability of other provisions.

A failure or delay by Labmallx Malaysia to exercise a power or right under these Terms and Conditions does not operate as a waiver of that power or right, and the exercise of a power or right by Labmallx Malaysia does not preclude its future ability to exercise that or any other power or right.

Insofar as they apply to the ordering, purchase, fulfilment and delivery of Labmallx Products from www.labmallx.com, these Labmallx Product Terms and Conditions and General Terms and Conditions are governed by and must be construed according to the law of Malaysia, and the parties submit to the jurisdiction of the courts in that State.

No LAbmallx Malaysia (i.e. PLT Scientifc Sdn Bhd), employee or agent has the authority to vary any of the Terms and Conditions governing any sale.

In respect of any Order, certain duties and taxes may be levied by the destination country to which your Labmallx Products will be delivered. You will be the importer of record for the purpose of customs and border processing. As the importer of the Labmallx Products, you agree that you are liable to pay such duties and taxes with respect to the LAbmallx Products to the relevant authority in addition to your payment to us under the General Terms and Conditions above. It is your responsibility to determine whether any such taxes apply in your destination country for delivery or the country from which the Labmallx Products are shipped. You agree that neither Labmallx Malaysia nor PLT Scientific Sdn Bhd is liable to you with respect to any loss, damage, cost, expense or injury you incur as a result your obligation to pay taxes in a particular jurisdiction.

7.”Apparatus”, “Chemicals”, “Consumables/Disposables”, “Glasswares” and “Plasticwares” from Labmallx do not come with warranty and non-returnable!
